Platform terms
These Terms explain how Evidence Based Change Builder may be used by coaches, clinicians, organisations, researchers, and other professional users.

These Terms are a draft operational version prepared for product launch and legal review. They are not legal advice. If your use involves clients, participants, patients, employees, research participants, health data, safeguarding duties, or regulated professional work, you should confirm that the right contractual, data-protection, ethics, and governance arrangements are in place.
These Terms apply to access to and use of Evidence Based Change Builder, including the public website, waitlist, early-access builder, app, Studio services, project pages, rollout links, and related support.
Evidence Based Change Builder is intended for professional and organisational use by coaches, clinicians, organisations, researchers, educators, and related teams. It is not intended to be used by patients, clients, employees, or research participants as an emergency or crisis service.
If you use Evidence Based Change Builder on behalf of an organisation, coaching practice, clinical service, research team, university, employer, or other entity, you confirm that you have authority to act for that entity. In these Terms, Customer means the person or entity that registers for, requests, receives, configures, or uses Evidence Based Change Builder for a project, programme, service, or study.
Evidence Based Change Builder is currently offered through waitlist signup, invitation, early-access arrangements, and project-specific conversations. Joining the waitlist does not guarantee access, availability, pricing, features, or participation in any early-access programme.
If we agree paid access, managed delivery, bespoke setup, or a pilot project with you, the commercial details, fees, payment timing, support scope, cancellation rights, and any project-specific terms will be agreed separately in writing.
You must provide accurate account, organisation, project, and contact information when requesting or using access, and you are responsible for keeping that information up to date.
Evidence Based Change Builder helps Customers create and deliver research-informed behaviour-change, wellbeing, coaching, organisational, learning, or research journeys. Depending on the project, this may include activities, exercises, check-ins, reminders, external survey checkpoints, project links, pseudonymous matching identifiers, and related project configuration.
The platform may store account information, waitlist information, project settings, journey content, external survey links, participant or client access tokens, pseudonymous labels, pseudonymous project/client identifiers, operational logs, security metadata, and support records.
Evidence Based Change Builder does not, by default, host or store answers submitted to external survey platforms. Where a Customer links to a third-party survey tool, such as Qualtrics, Tally, Microsoft Forms, Typeform, Google Forms, or another provider, the survey answers are submitted to that third-party service under the Customer's own configuration and legal arrangements.

You must not use Evidence Based Change Builder to mislead clients, participants, employees, research participants, or other users about who is responsible for a project, who is collecting their data, where survey answers are stored, how responses will be used, or who can access them.
Evidence Based Change Builder is a software tool. It does not provide legal, medical, clinical, psychological, therapeutic, safeguarding, employment, ethics, or regulatory advice.
If you use Evidence Based Change Builder in coaching, clinical, health, wellbeing, workplace, educational, research, or other regulated contexts, you are responsible for professional judgement, participant/client suitability, risk assessment, supervision, ethics approval where needed, safeguarding procedures, escalation routes, data protection, and compliance with applicable rules.
Evidence Based Change Builder should not be used as an emergency service, crisis intervention tool, clinical monitoring system, or substitute for professional care. You must provide appropriate support routes and emergency information where your project context requires it.
Evidence Based Change Builder is designed to support pseudonymous client or participant tracking where that is appropriate for a project.
The platform may generate or use generic pseudonymous project/client identifiers so that activity progress, journey state, or external survey checkpoints can be linked without needing to pass direct identifiers such as names or email addresses to external survey platforms. These identifiers may be passed to external platforms through URL parameters or hidden fields where the Customer configures that flow.
You must use pseudonyms, internal references, or non-identifying labels unless you have a lawful basis and a clear need to use directly identifying information. You remain responsible for any labels, names, notes, links, videos, or other content you add.
Pseudonymous identifiers reduce identifiability, but they should not be described as fully anonymous where they can be used to link responses from the same individual or where other information could reasonably identify someone.
You must keep access links, invite links, return codes, PINs, handoff tokens, and similar access materials secure and must not publish or share them in a way that compromises privacy, security, or project integrity.
External survey platforms and other third-party services are not operated by Evidence Based Change Builder. Your use of those platforms is governed by your own agreement with the relevant provider.
You are responsible for configuring external platforms correctly, including any hidden fields, URL parameters, consent language, retention settings, access controls, region settings, and export or reporting arrangements.
You are responsible for reviewing whether your external provider stores data in appropriate regions, provides suitable security controls, supports your retention requirements, and offers any data processing terms you need.
Evidence Based Change Builder is not responsible for loss, corruption, unauthorised access, misuse, deletion, or unavailability of data stored in external platforms selected or configured by the Customer.

For Customer-controlled project content, client or participant labels, external survey links, pseudonymous identifiers, rollout links, and related project configuration, the Customer determines the purpose of the project and is responsible for the legal basis, notices, permissions, consents, approvals, and safeguards given to participants or clients.
Where Evidence Based Change Builder processes personal data on behalf of a Customer, the parties may need a separate data processing agreement or project-specific data protection terms. If your use involves personal data, special category data, health data, employee data, child data, research data, participant data, or other regulated data, you must make sure appropriate terms are in place before using the platform for that purpose.

We may suspend, restrict, or terminate access if we reasonably believe your use breaches these Terms, creates legal or security risk, misuses participant/client data, or may harm clients, participants, Customers, other users, Evidence Based Change Builder, or third parties.
You retain ownership of the journey content, project configuration, survey links, labels, videos, text, prompts, activities, instructions, and other materials you submit to Evidence Based Change Builder.
Photo-based activities: Images selected for photo-based activities are processed locally in your browser/device and are not uploaded to our servers, stored by us, or shared with us. If you choose to download or share an image, collage, or other output elsewhere, that sharing is controlled by you and may be subject to the terms and privacy policies of the service you use.
You should only use images you have the right to use, and should not include confidential, clinical, client, patient, participant, or sensitive images unless you have the necessary permission and safeguards.
You grant us a limited licence to host, copy, process, display, transmit, back up, and adapt Customer content as needed to provide, secure, maintain, support, and improve Evidence Based Change Builder.
You confirm that you have all rights, permissions, approvals, and licences needed for the content, materials, links, measures, tools, and third-party services you add or connect to Evidence Based Change Builder.
Evidence Based Change Builder, including its software, user interface, workflows, templates, design, documentation, activity catalogue, platform structure, and underlying technology, is owned by us or our licensors.
Except for the limited right to use Evidence Based Change Builder during an agreed access period or project, these Terms do not transfer any intellectual property rights to you.
Feedback or suggestions you provide may be used by us without restriction or payment, provided we do not use your confidential information or personal data contrary to applicable privacy, data protection, or contractual obligations.
We aim to provide a reliable service, but Evidence Based Change Builder may be unavailable from time to time for maintenance, updates, security work, third-party outages, infrastructure issues, or events outside our control.
We may modify, improve, add, or remove features. Early-access, beta, preview, experimental, or pilot features may be changed or withdrawn and may be less stable than generally available features.
Each party may receive confidential information from the other. The receiving party must protect confidential information using reasonable care and use it only for purposes connected with these Terms or the relevant project.
You are responsible for securing account credentials, controlling who has access to your workspace or project links, and promptly telling us about suspected unauthorised access.
Evidence Based Change Builder is provided on an "as is" and "as available" basis to the fullest extent permitted by law.
We do not warrant that Evidence Based Change Builder will be uninterrupted, error-free, or compatible with every third-party survey, calendar, video, learning, research, or communication platform. We do not warrant the availability, security, legality, suitability, or performance of external platforms selected or configured by the Customer.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.
To the fullest extent permitted by law, we are not liable for indirect, consequential, special, incidental, exemplary, or punitive losses, or for loss of profits, revenue, goodwill, business opportunity, anticipated savings, or data, whether arising in contract, tort, negligence, breach of statutory duty, or otherwise.
You are responsible for claims, losses, costs, and liabilities arising from your project content, external survey content, use of third-party platforms, breach of these Terms, professional decisions, research governance, clinical or safeguarding responsibilities, or unlawful processing of participant/client data.
You may stop using Evidence Based Change Builder at any time, subject to any separate written agreement that applies to a paid, managed, pilot, or bespoke project.
We may suspend or terminate access if you breach these Terms, fail to meet agreed payment or project obligations, create security or legal risk, misuse participant/client data, or use Evidence Based Change Builder in a way that may harm others.
After termination, your access may end and Customer content may be deleted or retained according to our retention practices, privacy information, data processing terms, project-specific agreements, and legal obligations.
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify Customers, such as by email, account notice, website notice, or in-product notice.
Continued use of Evidence Based Change Builder after updated Terms take effect means you accept the updated Terms. If you do not agree, you must stop using the platform.
These Terms are governed by the laws of England and Wales, unless a separate written agreement says otherwise or mandatory law gives you rights in another jurisdiction.
The courts of England and Wales have exclusive jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.
